2. Applicability

2.1 These General Terms and Conditions are applicable to all offers, purchases and deliveries of products that can be obtained via www.invictastores.eu. By making a purchase on our website, you agree with the General Terms and Conditions.

2.2 These General Terms and Conditions can always be viewed via the website. Upon request, a digital copy of the General Terms and Conditions can be sent to the consumer. In case of differences between versions in languages, the Netherlands version shall prevail.

2.3 Invicta Watch Europe has the right to change the General Terms and Conditions from time to time. Possible changes are applicable to orders placed on or after the date of change that is stated in these General Terms and Conditions.

3. Offer

3.1 If an offer has a limited validity duration or takes place under terms and conditions, then this will be stated at the offer.

3.2 The offer contains a complete and precise description of the offered products. The description and specifications are in sufficient detail, to make a good assessment of the product possible. The product images are as much as possible a reflection of the product, the images can differ, dependent on the colour settings on your PC.

3.3 Invicta Watch Europe is not bound in case of mistakes or obvious errors.

4. Agreement

4.1 The agreement will be concluded, under the precondition of the stipulations in section 3, on the moment that the consumer accepts the offer and meets to the terms and conditions set thereby.

4.2 Invicta Watch Europe will confirm the receipt of the acceptation of the offer via the e-mail address stated by the consumer. The consumer is responsible for stating the correct e-mail address in the ordering process. As long as the receipt of the acceptation has not yet been confirmed by Invicta Watch Europe, then the consumer can dissolve the agreement.

4.3 Invicta Watch Europe can inform itself, within the framework of the law, whether the consumer can comply with his payment obligations, as well as about the facts and factors that are of importance for a responsible conclusion of the agreement. If Invicta Watch Europe, further to this investigation, has well-founded reason(s) not to enter into the agreement, then it is authorised, without statement of reasons, to refuse an order or application, or to set special terms and conditions for it.

4.4 Invicta Watch Europe shall send no later than at the delivery of a product, in writing or in such a manner, that this can be stored by the consumer, the following information:

- the address of Invicta Watch Europe where the buyer can submit a complaint;

- the terms and conditions under which the consumer can make use of the right of recall and the manner in which this should happen;

- information over warranties and after-sales service;

- the price of the product inclusive of VAT, the costs for delivery and manner of payment.

5. Prices

5.1 Invicta Watch Europe reserves the right to always change and/or correct prices, also in case of final sales. If a price is incorrect, then this can bring Invicta Watch Europe to cancel the purchase and to return a possibly paid amount.

5.2 All prices on the website www.invictastores.eu, are inclusive of VAT and in agreement with applicable legislations. Upon shipment of an order to an address outside the EU, import duties and taxes can be applicable, that will be collected when the order will be delivered to the stated delivery address. The buyer is responsible for the payment of such import duties and/or taxes. Invicta Watch Europe has no control over these costs and, since these costs differ per country, it cannot predict these costs.

6. Payment

6.1 Payment takes place via the payment method selected by the consumer during the ordering process. All payments take place via a secured payment environment. If the consumer does not (fully) comply with his payment obligation, then Invicta Watch Europe reserves the right to cancel the order.

7. Shipment

7.1 Invicta Watch Europe shall observe the greatest possible care at taking into receipt at the execution of orders.

7.2 As place of delivery, is the delivery address that has been stated by the consumer. The consumer is responsible for correct statement of the delivery address. Invicta Watch Europe is not responsible for delivery problems because of the statement of a wrongful address.

7.3 The shipment costs will be calculated based on the delivery address.

7.4 All delivery terms stated on the website, must be seen as estimated delivery terms. Delivery terms cannot be seen as definitive or guaranteed.

7.5 The risk of damaging and/or gone missing of products lies with Invicta Watch Europe until the moment of delivery to the consumer, unless explicitly agreed differently. Opened or seriously damaged packages must be refused by the consumer. Invicta Watch Europe shall then try to come to a solution with the transporter and consumer.

8. Reconsideration period and dissolution

8.1 Unless stated differently, the consumer can dissolve the agreement regarding the purchase of a product within 14 days without statement of reason(s). Invicta Watch Europe may ask the consumer for the reason of recall, but not oblige him to a statement of his reason(s).

8.2 The reconsideration period mentioned in section 8.1, starts on the day of receipt of the product.

8.3 If the consumer wants to make use of his right of recall, then he will report this within the reconsideration period to Invicta Watch Europe This by contacting the Customer service. The consumer bears the direct costs of the returning of the product.

8.4 During the reconsideration period, the consumer shall carefully deal with the product and the packaging. Products must be returned in the state of new, therefore undamaged, in its entirety (therefore not shortened, if it concerns a steel band) and in original packaging with all delivered accessories. If a returned purchase does not comply with the abovementioned requirements, then Invicta Watch Europe reserves the right to deduct from the repayment due to the consumer, an amount equal to the reduction of value of the products. This can possibly be 100% of the purchase amount.

8.5 If a product has been purchased as a special offer that included also other products (for instance 1+1 gratis), then the entire purchase must be returned, to be eligible for full refunding.

8.6 The consumer is responsible for the risk during transport. Invicta Watch Europe advises the consumer explicitly to return the product insured. After receipt of the return shipment, the repayment shall take place as soon as possible, but no later than within 14 days after receipt.

8.7 The risk and the burden of evidence for a correct and timely execution of the right of recall lie with the consumer.

8.8 If certain levies and/or taxes are due because the shipment has been imported in the country of delivery chosen by the consumer, then these costs will come for the account of the consumer. Upon refunding, these costs will be deducted from the purchase amount, insofar these costs have been brought into account to Invicta Watch Europe

9. Warranty and repairs

9.1 Invicta Watch Europe provides a term of warranty of two years from the date of purchase. The consumer can obtain a one-year extra warranty, therefore 3 years in total, by registering the purchase on www.invictaservice.com.

9.2 The warranty covers possible production errors, to be assessed by the official Invicta Service Centre for Europe, and the clockwork. Other parts, such as the glass, the crown and the band do not fall under the warranty.

9.3 In the following instances, costs can be brought into account for repairs or replacement of parts, also if the warranty period has not yet expired:

- Defects or damage caused by improper use or carelessness;

- Defects or damage caused by fire or water or a natural disaster, like an earthquake;

- Defects or damage caused by improper repairs or modifications by third parties;

- Changes that take place during normal wearing (wear and tear and aging);

- If no proof of warranty or purchase will be submitted with the watch.

9.4 For the replacement of the battery, costs will be brought into account.

9.5 Most of the Invicta watches are water tight. The designations mean the following:

- 3 ATM/30 metres: the watch is resistant against splashing water. The consumer cannot swim or dive with the watch.

- 5 ATM/50 metres or higher: the consumer can swim with the watch, provided that the watch has a screwed crown.

- 20 ATM/200 metres or higher: the consumer can swim and dive with the watch, provided that the watch has a screwed crown.

Be aware: Invicta Watch Europe strongly advises against taking a shower with a watch, irrespective of the water tightness. Because of the difference in warmth under and outside the shower, the air inside the watch can condensate, also with diving watches. Invicta Watch Europe reserves the right to bring costs for repairs as a consequence hereof, into account to the consumer.

10. Personal data and privacy

10.1 Invicta Watch Europe only stores personal data of the consumer which is to be able to comply with the agreement. Invicta Watch Europe warrants that utmost care will be dealt with this personal data.

10.2 The consumer has the right to view his or her personal data, to change or to remove it. The personal data will not be shared with third parties, with the exception of the transport company which shall deliver the order.

11. Complaints procedure

11.1 The consumer must carefully check the product upon receipt. If the product has been received damaged, or a wrong product has been delivered, then the consumer must report this within 7 days to Invicta Watch Europe via the Customer service. Hereby, the order number and a clear description of the complaint must be submitted.

11.2 The consumer must give the entrepreneur in any case 4 weeks to resolve the complaint in mutual consultation.

11.3 The Customer service of Invicta Watch Europe can be reached from Monday to Friday, from 9.00 to 17.00 hours (GMT +1).

12. Liability

12.1 Invicta Watch Europe warrants the consumer that each product that will be ordered via www.invictastores.eu, is of good quality and reasonably suitable for all purposes, for which such a product normally will be purchased.

12.2 Invicta Watch Europe is not responsible for theft or loss of products.

12.3 Invicta Watch Europe is not liable for delays in delivery, after transfer of the package to the delivery service.

12.4 Invicta Watch Europe is, insofar permitted by law, solely liable for the amount that was paid for the purchase of the concerned products.

13. Fraud

13.1 In ace of suspect circumstances, Invicta Watch Europe reserves the right to cancel a purchase.

13.2 All instances of fraud will be reported to the authorities.

14. Applicable law

14.1 Solely the Laws of the Netherlands are applicable to all agreements between Invicta Watch Europe and the consumer, to which these General Terms and Conditions concern. The consumer can however make a claim under mandatory legislation that applies in the country where the consumer resides.
